The inspirational concept regarding JTE Law is based on "research" and "services" to the general public on a global international scale. The rational thinking would as such focus on international law.
What is international law? Arguably, "Public International Law" is generally considered to be the "Law of Nations" or the law that is created and interpreted by Sovereign Nations.
As a rule of thumb, the adjective "Public" should be contrasting with another adjective which is "Private", and hence the nexus with "Private International Law". In terms of definition, Private International Law is the law with regard to relations between individuals, legal entities or corporations when the given relations have an international nature or origin.
Some aspects of Private International law:
- A Man from Saudi Arabia (Saudi Arabian) marries a British Lady in Thailand, the couple resides in Denmark, with 2 kids that were born in Osaka (Japan) and the couple finally divorced in Puerto Rico (not really within the USA).
Which of the aforementioned countries has the Jurisdiction to preside over divorce Case? Is it British Law, or Saudi Arabian law or Thailand Law, or Japanese Law, or US Law that applies in this Case? And these are some of the given questions with respect to Private International Law.
- A Malaysian company sells goods
to a Company in South Africa, and that the goods are shipped using "Emma Maersk" (arguably, the largest container vessel in the world or one of the largest container vessels in the world that belongs to shareholders residing in Denmark).
The vessel is insured with an insurance company based in Lichtenstein, and the vessel on its way to deliver the goods, finally sinks around the "Gulf of Aden" after a collision with an Oil tanker owned by the US-Military.
Which of the aforementioned States has the optimal jurisdictional powers to preside over the case regarding settlement of insurance claims, for or against the seller or beneficiary of the goods? That is the key question in private international law.
